III. COMMENTS - COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> This was a partial coal inspection conducted by Jason Musick of the Colorado Division of <br /> Reclamation, Mining, and Safety(Division)on 08 December 2009. The weather was cloudy and <br /> snowing. The mine site was wet with substantial snow cover during the on-the-ground inspection of <br /> the site. Jeff Dubert of BME was informed of the inspection. <br /> The mine is currently operating as permitted. Deserado Mine continues to longwall in panel 10. <br /> Roads <br /> The access road to the facilities area was well maintained with no problems noted. The haul road <br /> was snow covered and was stable with no signs of erosion or damage. The conveyor corridor road, <br /> access roads and light-use roads were snow covered and appeared to be in good condition with no <br /> problems noted. All roadside ditches and diversions were snow covered at the time of the inspection. <br /> Reclamation Success <br /> Ongoing reclamation of degas boreholes was in process at the time of the inspection. The pads for <br /> Borehole LW B 9-2 and Nitrogen Injection Hole SC HG-33 were snow covered with and graded at the <br /> time of the inspection. <br /> LWB 9-2 Reclaimed Pad <br />
