Pagel 2 <br />PerPit Response Letter to State 12- 7 -09.doc <br />Rule 3.1.9(1) Topsoil: Please confirm that any topsoil /overburden left in place for more than 180 <br />days or one growing season will be protected from wind and water erosion with the temporary <br />seed cover proposed in the reclamation plan. <br />Response: The operator agrees and this condition has been added to Exhibit E. <br />Rule 3. 1.10 Revegetation: <br />(1) While it is understood that natural grasses and shrubs are limited on site, it appears the seed <br />mix proposed is not diverse. Two bromes and two wheat grasses are proposed. A nitrogen <br />fixer such as Cicer milkvetch and another grass such as Sheep Fescue should be added to the <br />mix to improve reclamation success. <br />Response: The seed mix has been updated within Exhibit E. <br />(2) Please commit to ensuring no livestock will be permitted on site until the permit or area is <br />released by DRMS. <br />Response: The operator commits to this condition which has been added to Exhibit E. <br />6.4.7 - Exhibit G Water information is adequate. Please note response by the applicant to comments from <br />DWR are still pending. <br />Response: A copy of the response letter to DWR was sent to you on Dec. 3rd. <br />6.4.8- Exhibit H Wildlife. Please note response by the applicant to comments from DOW are still pending. <br />Response: A copy of the response letter to DOW was sent to you on Dec. 3rd. <br />6.4.19- Exhibit S, Permanent Man -Made structures need to identify two culverts on County Road 21. <br />Response: Exhibit S has been revised to this affect. <br />Rule 6.5: Geotechnical Stability Exhibit appears to be adequate.
