reclamation. Future reclamation plans must be addressed as a revision to the <br />permit. <br />A detailed topsoil redistribution plan for the upcoming year must be submitted as <br />a Minor Revision to the permit, prior to topsoil replacement. This revision will <br />provide details for a specific reclamation block(s) within the framework of the <br />approved topsoil replacement plan. A map or plate showing the proposed plan for <br />each year's reclamation block(s) will be included in the revision. This map or <br />plate will need to be a zoomed view of the reclamation block(s) so enough detail <br />can be shown. The scale of Map 5A is too large to provide this level of detail. <br />The proposed topsoil replacement plan revision will contain a map showing the <br />location of the topsoil replacement, and a description of the depth of topsoil that <br />will be replaced (the replacement zones, as discussed in question 1 above). These <br />annual plans may be included in a new appendix titled "Annual Topsoil <br />Replacement Plan". If major changes are proposed to the topsoil replacement <br />plan, a Technical Revision will be required. Please add this commitment, where <br />appropriate, to the narrative on Pages 2.05-46 through 2.05-50. <br />Colowyo's Response: <br />To clarify, Colowyo has proposed to provide (through the Annual Reclamation Report) <br />the Division with the past year's reclamation unit description polygon, including the <br />location of constructed contour furrows or any other special features, the volume of <br />topsoil applied and an explanation of any deviations from required averages, transects <br />detailing the distribution of the topsoil within the reclamation unit through specific depth <br />measurements and their locations within each unit, and an updated topsoil balance that <br />reflects the most recent reclamation activities including additional topsoil stripping and <br />stockpiling. <br />In addition, Colowyo has proposed to provide the Division with detailed plans for areas <br />expected to be reclaimed during the next two years in order to inform the Division of <br />what areas will be targeted moving forward. Anticipated topsoil volumes, distribution <br />and any special features will be included in the description so that the Division will have <br />an understanding of how Colowyo will be focusing the reclamation effort. This process <br />also allows the Division to bring up concerns that they may have as it relates to those <br />areas and give both parties the opportunity to resolve any questions prior to the field <br />season later on that year. <br />Colowyo is not asking to and is not required to submit annual topsoil redistribution plan <br />revisions. The information provided within the context of TR-72 and TR-82 provide the <br />Division with a clear picture of intent and verifiable metrics to ensure topsoil is replaced <br />as discussed within the text to meet the criteria set forth for the achievement of the <br />approved post mine land uses of Sagegrouse Brood Rearing Habitat and Grazingland <br />through demonstration at the time Colowyo seeks Phase III bond release on these areas.
