III. COMMENTS -COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> Hydrologic Balance <br /> • Pond 007 - the water level was approximately 2 feet below the elevation at which discharge will <br /> occur. <br /> • Pond 008-The water level continues to drop, due to cessation of seasonal irrigation. The slopes are <br /> stable and well vegetated. Weeds on the eastern bank were sprayed this year, and have been <br /> conquered. <br /> • Pond 009-Dry <br /> • Pond 011 -The water level in the pond was lower than usual, exposing the valves at the discharge <br /> structure. Inflow to the pond from mine dewatering was occurring at a rate of 310 gallons per <br /> minute. Pond in-slopes are stable with respect to erosion. <br /> • Pond 012 - Shallow water continues to be present in the bottom of the pond. Rather than <br /> contributions from surface flow, the source of appears to be seepage of groundwater from the <br /> adjacent Tuttle Draw. <br /> • Pond 013- As with Pond 012, this pond is influenced by groundwater seepage from the Tuttle Draw <br /> drainage to the north. The bottom of the pond continues to be dotted with puddles. <br /> • Pond 014 has been obliterated with the BB Road Detour reclamation project that is under way. <br /> Topsoil <br /> • Topsoil spread on the Lloyd parcel (north of the future BB Road alignment) has been rock-picked, <br /> disc-ed, and partially seeded (Figure 4). <br /> Fish & Wildlife <br /> • Numerous mule deer were sighted on the reclaimed lands in the eastern portion of the permit area. <br /> • On the WFC parcel in the northwest corner of the permit, a red-tailed hawk occupied a large <br /> cottonwood tree. <br /> • A flock of ducks scattered from Pond 012 as we approached. <br /> Revegetation <br /> • Additional acreage has been seeded since the October inspection. Only 15 acres remain to be <br /> completed this year. If weather conditions present an obstacle, the remaining seeding will be <br /> accomplished in the spring of 2010. <br /> • Approximately 30 head of cattle and a few horses are grazing the several hundred acres of <br /> reclaimed pasture bounded by BB Road, 2700 Road, 5th Avenue and the Mine Haul Road. This is <br /> part of the area covered by the Partial Phase III portion of the SL-12 bond release application. <br /> Prime Farmland <br /> • "Mixed A and B" topsoil has been recently spread on previously backfilled and graded Morgan <br /> property (Figure 5). (Placement of "mixed" topsoil in this manner was approved with TR-57 for <br /> reclamation of Morgan fields which were disturbed prior to the determination that the soils are <br /> classified as prime farmland and the various horizons must be stockpiled and distributed separately.) <br /> • Survey lath, marked to show the required thickness of topsoil, had been placed around the <br /> perimeter of the area being topsoiled as a guide to the dozer operator. <br /> • The topsoil pile on the Morgan property continues to grow in size (Figure 6). <br /> New Horizon Mine C-1981-008 16-Nov-2009 <br /> -2- <br />
