Cattany <br />Division Director <br />Natural Resource Trustee <br />We have received your letter of November 25, 2009 in which you request verification that the <br />release of leases in the King I Mine area will not conflict with the terms of your mining and <br />reclamation permit. <br />Section 2.03.6 of the permit application identifies several coal leases which appear to be the <br />documents upon which the mine operator relies for surface right of entry. If the operator relies <br />on a mineral lease for surface right of entry, then the lease would need to remain in effect until <br />either the lease area receives final bond release or an alternate form of surface right of entry is <br />obtained for the lease area. <br />The need to maintain surface right of entry over undermined areas comes from Rule 2.03.6(1) <br />which effectively requires the mine permit application to describe the documents which give the <br />mine permittee the legal right of entry for the land surface in the affected area.
