Cattany <br />Division Director <br />Natural Resource Trustee <br />Re: Conger Harvest Area, Permit M-1998-022, CN-01, Reclamation Liability Review. <br />Dear Mr. Balaz, <br />The Division of Reclamation Mining and Safety has received Tetra Tech's response to <br />staff review of the above referenced application. It appears that all issues have been <br />addressed to meet the minimum requirements of the Act and Rules. Staff notes the <br />objection received has been withdrawn. Therefore, the final step prior to a decision is <br />the agreement of the reclamation liability estimate. <br />Please find enclosed the Final Reclamation Liability Estimate prepared by DRMS. The <br />estimate is similar in amount to that provided within the application. The conversion <br />application expands the work area available but does not change the mining plans per <br />say. Therefore, staff updated the 2001 bond calculations to reflect current costs. <br />Staff has calculated the reclamation liability to be $7,725.00. This is a $305.00 increase <br />in the bond already held by the Division. Please review the estimate and contact staff <br />immediately if there are any discrepancies or errors that might affect the overall costs. <br />If Gallegos Corporation accepts the estimate, staff will need written acceptance prior to <br />issuing a decision. <br />Since the new portion of mining will occur primarily on Forest Service lands a copy of <br />the estimate has been forwarded to them for their review and acceptance per a Memo <br />of Understanding. Visual impacts may be an issue that will need to be addressed in the <br />future. This is an issue outside the Division's jurisdiction and we cannot bond for a task <br />that is subjective at this time. Several methods could be used to mitigate the impact if it <br />occurs. It will be up to all parties to agree upon a preferred method should it become a <br />real issue. It should also be noted that the original permit area is reclaimed except for <br />Office of Office of <br />Mined Land Reclamation Denver • Grand Junction • Durango Active and Inactive Mines
