In all cases the units of measurement must correspond to the units used in the <br />appraisal. <br />Specific changes that I see are necessary are: <br />1. Immediate withdrawal from mineral entry as required in the LMP. <br />2. Selecting the no action alternative based on the fact that no determination was <br />made determining that no other source was available on private lands (as required <br />by the LMP (see attached) or elsewhere on National Forest System Lands not <br />within the proposed Wild and Scenic River Corridor. <br />3. A fair market appraisal of the mineral material must be made (see 3 above) <br />even if the Deciding Official is upheld prior to sale. <br />4. An operating plan as required in FSM 2800 ("2855 - OPERATING PLANS. <br />All surface-disturbing operations under mineral materials contracts or permits <br />require an operating plan. A plan has no special format; its complexity and length <br />may vary with the scope of the proposed operation and with the anticipated <br />environmental impacts. The only requirement is that the plan must include the <br />information specified at 36 CFR 228.56. Any revisions to the original operating <br />plan require approval of an authorized officer. Prepare operating plans for in- <br />Service pits, community sites, and common-use areas 36 CFR 228.64(b). <br />Purchasers and permittees submit their own operating plans in all other cases.") is <br />submitted prior to the start of operations even if the Deciding Official is upheld <br />prior to sale. This actually should have been submitted before the EA was done, <br />but no mention of an operating plan was mentioned in the EA. <br />I believe that the Deciding Official's decision did not consider my substantive comments, <br />because no mention of these comments are found in the DN. <br />I believe that the decision violates the LMP (see above and attached). <br />I believe the decision violates FSM direction (see above). <br />I believe that the decision violates 36 CFR direction (see above). <br />Thank you for the opportunity to review and comment on the above project. <br />Gary T.
