PAN 5 E.? <br />Dear sir: <br />This letter addresses only the two outstanding issues: <br />1. Authority to mine <br />2. Geotechnical stability <br />In addition, as discussed, we are requesting an extension of the decision date from 30 November <br />2009 to 31 January 2010, to allow time to review and further comment and respond on any <br />remaining issues, and because we have been unable to obtain the necessary documents from the <br />BLM. This is done with the understanding that if the issues are resolved more quickly, the <br />decision can be made more quickly as well. Thank you for your understanding in this. <br />As discussed in conversations, we have again requested that BLM correct the mineral <br />lease/purchase agreement to show the correct sections of land involved. As soon as that is <br />available, we will provide a copy to the DRMS. <br />As requested, and based on your guidance, we have further elaborated on the actual proposed <br />post-reclamation terrain and structures, and on the measures proposed to ensure the stability of <br />the area of the new access road. Additional drawings are provided, and replace drawings <br />previously submitted for the Geo-Technical Stability Exhibit. These are intended to be <br />clarification and explanation of what has been proposed previously, and are not intended to be a <br />technical revision to the application. <br />There are a total of four sheets: GTSC-la shows pre-mining contours, the remainder show <br />proposed post-reclamation contours, with various features called out in each map, such as slopes <br />and roadways. All are to the scale of 1"=200'. The cross-section on GTSC-2b is taken from <br />Sheet F-6/17-7 of the amendment application, to ensure that it matches the original submittal. I <br />believe that all the items identified in Rules 6.2, 6.5, and your message are provided. <br />Please let us know of any further issues we need to resolve. <br />Respectfully submitted, <br />Nathan A.
