MANAGEMENT <br />Re: Bowie Resources, LLC, Bowie No. 2 Mine <br />TR-64 - Increase Height of Coal Refuse Pile No. 4, Adequacy Review #2 <br />Permit C-1996-083 <br />Dear Mr. Dudash: <br />The DRMS' letter dated November 9, 2009 transmitted its adequacy comments <br />regarding the subject technical revision. On behalf of Bowie Resources LLC (BRL) <br />following are its responses to the DRMS' comments and concerns. <br />Adequacy Items 1 - 7, 9- 16, 17 - 27 and 29: The Division has no further concerns. <br />8. DRMS - CMWDA-4 has been designed with the intention of first excavating <br />native soils in order to create an available area for placement of the coal mine <br />waste. The Buckhom Geotech report dated February 1, 2007 evaluated overall <br />excavation slopes of 2.51-1: 1V and 2H: 1V. These slopes resulted in acceptable <br />upper waste fill slopes of 2.51-1:1 V and 31-1:1 V, respectively (page 3, paragraph). <br />The May 2009 Buckhorn Geotech report steepens the acceptable excavation <br />slope (assuming a 3:1 upper waste fill slope of 31-1:1 V) from 21-1:1 V to 3H:1 V. <br />Presumably it is this steepening of the acceptable excavation slope that accounts <br />for much of the potential increase in the volume of CMWDA-4. Section D-D' of <br />Volume IX Figure 1 illustrates the relative locations of the original ground surface <br />and the proposed ground surface. Missing from this Section is a line showing the <br />proposed excavation surface. Please modify Section D-D' to represent the <br />approximate limits of excavation that have preceded or are expected to precede <br />the placement of coal mine waste in CMWDA-4. <br />BRL: The Operator believes the 2:1 cut slope shown on Figure 1 is <br />representative of the construction that occurred and therefore does not plan to <br />revise Figure 1. <br />16 A. DRMS - Based on BRL's responses in the October 1, 2009 submittal, the <br />Division has calculated the reclamation cost estimate for TR-64. The revised <br />liability estimate for TR-64 is $93,936.00 and consists of a summary sheet, a task
