� Ie <br />o.. .... r ........e. , <br />ANNUAL RECLAMATION REPORT <br />DOWE FLATS MINE, LYONS, COLORADO <br />PERMIT NO. M- 1993 -041 '' <br />2007-2008 <br />The purpose of this report is to comply with the Mined Land Reclamation Act of <br />1976, Statute 34 -32 -112 of House Bill No. 1065. This report follows the <br />requirements covering annual reports in the Rules and Regulations of Colorado <br />Mined Land Reclamation Board, Section 2.4. The permit for the Dowe Flats <br />Mine was issued on May 20, 1993 and amended on December 14, 1994. <br />In March of 2009, CEMEX submitted a detailed report at the request of DRMS <br />to update the bond for this quarry. More detailed operational and disturbance <br />information can be obtained in this report. A copy of the " CEMES Disturbance <br />Acreages" map is enclosed. The major disturbances are: <br />• Quarry Pit ...................... ............................... 94 Acres <br />• Previously mined areas .............. ............................... 210 Acres <br />• Proposed future mining ............. ............................... 163 Acres <br />The topsoil and backfilled is stored in the temporarily reclaimed area labeled "A" <br />on the map and being moved to the reclaim the mining pit (also labeled on the <br />map). There were approximately 15 acres of backfilled pit completed with soil <br />and vegetation as reclaimed land in 2008 - 2009. An additional 15 acres of land <br />was disturbed by removal of topsoil during the same time period. Both of these <br />areas are hand drawn on the attached map. An additional proposed reclaim of <br />10 to 12 more acres using native grasses and plant species is planned for the <br />third and fourth quarters of 2010. No aerial flyover of the mine was conducted <br />or is scheduled due to slow market conditions. Active operations also ceased <br />November 14, 2009, also due to slow market conditions.
