(Page 2) <br />MINE ID # OR PROSPECTING ID #: m- 1998 -nAZ <br />INSPECTION DATE: 11.490409 INSPECTORoS INITIALS: RK— <br />OBSERVATIONS <br />The Division conducted a monitoring inspection of the site as part of sites to be <br />inspected during the fiscal years 2009 -2010. The site is phased 112 clay mine located <br />approximately 10 miles North West of Canon City. Present during the inspection was Mr. <br />Matt Welte of Summit Brick and tile. The total permit area of 280 acres includes Colorado <br />state and BLM lands, of which 131 acres can be affected in phases. <br />When the site was last inspected no major problem was noted. In addition to the normal <br />inspection DRMS also tested the PH of all the water that was ponded with in the pit area <br />and no problem was noted. The number of acres affected appeared to be the same as was <br />noted during the 2004 inspection, which was estimated to be 4 -5 acres. Pit was not active <br />at the time of the inspection, but fresh disturbance was noted along the north side of <br />the active pit area. The maximum acres to be affected at any give n time is 25 acres. <br />As noted in the 2004 inspection the operator had increased the warranty from the $25,000 <br />which was held at the time to $49,000.00.Given the amount of disturbance at this time the <br />warranty is deemed adequate. <br />The entire affected area was walked and inspected there was some ponded water along the <br />South west side of the active pit area, from the recent snow storm. <br />Mr. Welte stated that the operator plans to cut a new road to the BLM portion of the land <br />to access the clay. He was notified to submit a technical revision to add the road. If <br />the road is going to remain in place post mining to access the BLM land no additional <br />warranty will be needed. However a technical revision has to be submitted and an <br />appropriate map must included, in addition to a letter from BLM agreeing to leave the <br />road post mining. <br />Permit sign was properly posted at the access to the property.
