(Page 2) <br />MINE ID # OR PROSPECTING ID #: M -1977 -394 <br />INSPECTION DATE: 11 INSPECTOR ❑S INITIALS: RK— <br />OBSERVATIONS <br />The Division conducted a monitoring inspection of the site as part of sites to be <br />inspected during the fiscal years 2009 -2010. Present during the inspection was Mr. Matt <br />Welte of Summit Brick and Tile. <br />The site is an old clay mine located approximately 66 miles North of Canon City. Site was <br />not active at the time of the inspection. <br />The permit area covers 280 acres with a maximum affected acres to be limited to 18 acres <br />at a time. The current affected area was properly delineated and includes two pits. When <br />the site was inspected in 2005 by Harry Posey and Kate Pickford, the site was found to be <br />in compliance: with the approved permit. <br />Approximately 10 plus acres appeared to have been affected at the time of the inspection, <br />consisting of two separate pit areas. Overburden /growth medium was properly stockpiled <br />and protected. The current warranty in place is $38,500.00, which is deemed adequate at <br />this time to cover the current disturbance. <br />Given how old the permit is, and more than likely there was some pre law affected acres <br />within the 280 acres. If that is the acres operator should submit a new mining and <br />reclamation maps clearly delineating these pre- law affected acres to avoid future <br />liabilities. <br />Pit slopes were stable and did not exceed 10 feet in height. According to Matt, the site <br />is mined on as need basis and the current disturbance was from the time the permit was <br />issued in 1977. <br />Permit sign and affected acreage markers were properly placed. If operator plans to <br />increase the current maximum affected acres at any given time, the appropriate financial <br />warranty has to be posted and a written approval obtained from DRMS. <br />I & E Contact Address <br />NAME: MR.
