Cattany <br /> Division Director <br />Montrose, CO 81402 Natural Resource Trustee <br />Re: New Horizon Mine (Permit No. C-1981-008) <br />Permit Revision Application No. 6 (PR-6) <br />Post-Mining Land Use; Sediment Control; Final Contours; and Prime Farmland <br />Dear Montrose County Commissioners: <br />The Division of Reclamation, Mining and Safety hereby issues notice, in accordance with Title 34, Article 33, <br />Section 118, Paragraph 3, of the Colorado Revised Statutes, that on November 23, 2009, a permit revision <br />application for a permit to conduct coal mining operations, Permit No. C-1981-008 by Western Fuels-Colorado, <br />LLC, was considered complete for the purposes of filing. All review and comment periods as provided in the <br />Colorado Surface Coal Mining Reclamation Act and the Rules and Regulations of the Colorado Mined Land <br />Reclamation Board for Coal Mining initiate from this date of filing. <br />This revision seeks to modify the post-mining land uses; to revise the collection ditch and sediment pond system; <br />to adjust the post-mining surface elevations; and to address prime farmland concerns; all for permit areas located <br />west of 2700 Road. <br />The surface coal mining operation is located approximately 1 mile north of Nucla, Colorado. The permit area is <br />further described as follows: <br />Sections 25 and 36, Township 47 North, Range 16 West; Section 31, Township 47 North, Range 15 West; Section <br />6, Township 46 North, Range 15 West; and Section 1, Township 46 North, Range 16 West. <br />The above-mentioned tracts of land are shown on USGS 7.5 minute Quadrangle map of Nucla. <br />A copy of the revision application is available for public inspection at the Montrose County Courthouse Annex. <br />For additional information, to provide written comments, or request an informal conference, contact the Division <br />of Reclamation, Mining and Safety, Room 215, 1313 Sherman Street, Denver, Colorado 80203, (303) 866-3567, <br />within thirty (30) days after the last public notice in the San Miguel Basin Forum. <br />Sincerely, <br />Marcia L.
