Post-Mining Land Use; Sediment Control; Final Contours; and Prime Farmland
Dear Montrose County Commissioners:
The Division of Reclamation, Mining and Safety hereby issues notice, in accordance with Title 34, Article 33,
Section 118, Paragraph 3, of the Colorado Revised Statutes, that on November 23, 2009, a permit revision
application for a permit to conduct coal mining operations, Permit No. C-1981-008 by Western Fuels-Colorado,
LLC, was considered complete for the purposes of filing. All review and comment periods as provided in the
Colorado Surface Coal Mining Reclamation Act and the Rules and Regulations of the Colorado Mined Land
Reclamation Board for Coal Mining initiate from this date of filing.
This revision seeks to modify the post-mining land uses; to revise the collection ditch and sediment pond system;
to adjust the post-mining surface elevations; and to address prime farmland concerns; all for permit areas located
west of 2700 Road.
The surface coal mining operation is located approximately 1 mile north of Nucla, Colorado. The permit area is
further described as follows:
Sections 25 and 36, Township 47 North, Range 16 West; Section 31, Township 47 North, Range 15 West; Section
6, Township 46 North, Range 15 West; and Section 1, Township 46 North, Range 16 West.
The above-mentioned tracts of land are shown on USGS 7.5 minute Quadrangle map of Nucla.
A copy of the revision application is available for public inspection at the Montrose County Courthouse Annex.
