III. COMMENTS - COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during <br />the inspection. Comments also describe any enforcement actions taken during the inspection and the <br />facts or evidence supporting the enforcement action. <br />This was a partial inspection conducted by Janet Binns of Colorado Division of Reclamation, Mining <br />and Safety. Aerial photographs of the Foidel Creek Mine were taken on November 19, 2009, by <br />Division of Reclamation, Mining and Safety personnel, Harry Ranney. This inspection is a result of <br />review of these photos. The Foidel Creek Mine is a large active underground mine. The weather was <br />clear and the mine site is snow covered. <br />Roads: Haul Roads and access roads throughout the mine appear clear of snow. <br />Hydrologic Balance: <br />6MN reservoir is holding a small pool of runoff water and is frozen. The pump house pad has poured <br />been constructed for the pumphouse at the 6MN reservoir. The pumphouse has not been installed yet. <br />Ponds visible in the aerial photos include Pond D, Pond G, Pond E, Waste water treatment ponds, 6MN <br />reservoir, and 61VIN pond. All ponds visible from the aerial photos are frozen over. Only Pit I remains <br />open water. No problems with the ponds were apparent from the air. <br />Processing Waste: The refuse pile continues to accept refuse material. Refuse is being placed on the <br />southern end of the pile. No disturbance associated with TR67 have been initiated yet. <br />Support Facilities: ROM coal stock pile and BOB coal stockpile have large reserve in place. An <br />excavator was cleani BOB sump at the time the aerial photos were collected. <br />Parking lot, main office & warehouses, waste water ponds, ROM coal stockpile, Portal and pond E. <br />3of7 WHITE - File YELLOW - Operator PINK - Specialist <br />
