V . <br />X. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during <br />the inspection. Comments also describe any enforcement actions taken during the inspection and the <br />facts or evidence supporting the enforcement action. <br />This was a partial inspection conducted by Tom Kaldenbach of DRMS. Ryan Sweetwood of <br />Mountain Coal Company represented the operator. <br />Photographs taken during the inspection are attached to the end of this report. With the operator's <br />consent, this report was issued from the Denver office of DRMS. <br />The longwall was active more than half -way through E -Seam Panel 1. The ground ground in most <br />areas was clear of snow. <br />Hydrologic Balance <br />No discharge was occurring at the mine water discharge site in Sylvester Gulch (CDPS outfall 017). <br />Construction of the recently approved pond MB -5E has not begun. <br />Processing Waste <br />The outslopes of the Lower Refuse Pile were well- vegetated and showed no signs of instability. <br />Survey markers were in place on the outslopes. Much of the equipment has been removed from the top <br />of the LRP. The top of the LRP was dry and it gently slopes back away from the face to a culvert <br />downdrain. A new hoist and scale has been constructed on top of the LRP. Construction of the RPE <br />was active as the RPE nears its maximum designed elevation <br />Support Facilities <br />No problems were found in the following areas: barrel storage building, hydraulic components <br />storage, and the Sylvester Gulch mine water pumping facility. <br />General Mine Plan Compliance <br />The operator appeared to be following the approved mine plan. <br />Documents Received <br />None. <br />3 <br />
