Ill. COMMENTS -COMPLIANCE <br />Colowyo C- 1981 -019 <br />10 Nov 2009 <br />Pg 1/7 ��7 <br />Below are comments on the inspection. The comments include discussion of observations <br />made during the inspection. Comments also describe any enforcement actions taken <br />during the inspection and the facts or evidence supporting the enforcement action. <br />This was a complete inspection of the Colowyo Mine conducted by Jim Stark of <br />CDRMS. The inspection was conducted on 10, 11 and 12 November 2009, Ryan <br />Pawlowski of CCC accompanied me on 10 November 2009 and Jennifer Sekulski- <br />Barton of CCC accompanied me on 11 November 2009. The records were checked <br />on 12 November 2009. The mine was actively mining coal and hauling coal to the <br />loadout at the time of the inspection. The weather was warm, overcast and very <br />windy on all three days of the inspection. The Division collected elevation data from <br />the recently reclaimed slopes of the West Pit and the Prospect Ditch. The data was <br />collected with a Trimble GeoXT GPS unit. The elevations shown were not based on a <br />control point and are, therefore, relative elevations. <br />Availability of Records: - All of the necessary records were available in the records <br />room at the office building. Please see the DBMS Availability of Records form at the <br />end of this inspection report for more details. <br />Signs and Markers: - The mine ID sign was in place at the entrance and at all of the <br />ponds along Colorado Highway 13 (Streeter, Gulch A, Prospect and Section 28). The <br />signs contained all of the necessary information including permit number, mine <br />name, operator and permittee. <br />- Stream buffer signs were in place along Taylor Creek as required. <br />- All of the topsoil stockpiles had the appropriate signage. <br />Roads: - The main haul road to the office area and the loadout is a paved road. The <br />road is well maintained and stable. <br />- Colowyo is working on the new South Taylor Haul Road. This road will cut across the <br />West Pit and travel up Taylor Draw (just west of the East Taylor Fill) and into the South <br />Taylor Pit area (as approved by TR -76). This haul road will eliminate the need for the <br />Section 16 haul road (at which point the final cut of the Section 16 Pit can be <br />backfilled and regraded) and many of the roads that form a vast network in both the <br />West Pit and the South Taylor Pit. This will also aid in ongoing reclamation. Colowyo <br />basically has the road "roughed in" at this point. The remaining work includes <br />widening the road to its designed width in several locations, constructing berms on <br />the road, completing the roadside ditches and completing the runaway truck ramp. <br />At the time of the inspection Colowyo was dumping material for the runaway truck <br />ramp. The ramp is located at the bottom of the road basically at the end of the <br />South Taylor Pit where the road makes a 900 turn into the West Pit. *See pictures at <br />the end of this report* Colowyo is reminded that immediately following completion <br />of the South Taylor Haul Road they must provide the Division with an as -built drawing <br />and an haul road certification performed by a registered professional engineer. <br />
