III. COMMENTS -COMPLIANCE Below are comments on the inspection. The comments include discussion of observations made during the inspection. Comments also describe any enforcement actions taken during the inspection and the facts or evidence supporting the enforcement action. This was a complete inspection conducted by Janet Binns of Colorado Division of Reclamation, Mining and Safety. The mine is a reclaimed surface mine. The weather was cool, windy and dry. The main gate on the mine access road and the gate to the load out remain locked. The mine site and load out are snow covered with 4 -6 inches of snow. Elk tracks were noted across the Mine access road. Roads The mine access road was snow covered. The access road was drivable all the way to the facilities pad and warehouse. Fresh tire tracks went to the warehouse area. No vehicles were on site at the time of the inspection. The access road to the load out was also snow covered. Hydrologic Balance: The Load Out was not discharging and the permanent pool of water was frozen. Reclamation Success: The Division continues to retain liability bond for two reclaimed areas at the mine site, encompassing 8 acres along with the as the access road. The Division continues to retain liability bond for the Load out and load out access road as well. The vegetation at both parcels look good and have dried down for the year. There was evidence of vehicle access to power poles east of the warehouse area. No erosional features were evident. Offsite support facilities: There has been no new activity at the load out. No problems noted with the load out pond or with the reclaimed load out area. Records: Records were checked at the NWCC office in Steamboat on 11/18/2009. Most records are up to date.
