Cattany <br />Division Director <br />West Elk Mine (C- 80-007) Natural Resource Trustee <br />TR -118 <br />From: Tom Kaldenbach <br />Re: Summary of Review <br />I have reviewed the mine operator's submittal for compliance with the Rules, with special <br />attention to Rule 4.04 (Surface Facilities). Correspondence in the TR -118 file from the <br />SEO, OSM, and CDOW indicate the proposed work will not damage fish, wildlife, or <br />water rights. The wash plant will minimize water use and erosion by using a closed <br />water system. Air pollution will be minimized by complying with the air emissions <br />permit. Marcia Talvitie's review concluded the submittal adequately demonstrates <br />structural stability. The submittal included an updated map of the Surface Facilities, Map <br />53. The proposed work will occur on previously disturbed lands that report to sediment <br />control ponds. No changes to the reclamation plan are proposed. I have prepared a <br />reclamation cost estimate. The mine operator's notice was published on August 19, <br />2009. Comments that were received haveA reclamation cost estimate for TR -118 is <br />attached.
