(Page 2) <br />MINE ID # OR PROSPECTING ID #: M-2004-078 <br />INSPECTION DATE: 11/17/09 INSPECTOR'S INITIALS: FCS <br />OBSERVATIONS <br />This was an acreage reduction inspection for the Lupton Lakes site, a 112c sand and gravel quarry permitted by <br />Denver Water and operated by Lafarge aggregates and concrete. The inspection was conducted by Eric Scott of <br />DRMS. DRMS visited the site at 1300 on November 17, 2009 with John Bambi and Michael Walker of Denver <br />Water. The focus of this inspection is a 2.98 acre area located at the SW corner of the permitted area north of <br />County Road 6 1/4. This property is not owned by Denver Water and has never been mined. Release of this area <br />was requested by Denver Water on October 16, 2009. <br />At the time of the site visit, the 2.98 acre area proposed for release had been well marked with orange lath. <br />Although the area proposed for release was never mined, it has been affected by mining activities. A topsoil <br />stockpile berm is currently located on a portion of the proposed release area, and the existing "site fence" also <br />currently runs through this 2.98 acres. The remainder of the proposed release area lies outside the "site fence" <br />and has been totally unaffected by mining activity. <br />Because of these issues, the acreage release of this 2.98 acre area the Lupton Lakes site will have to be denied at <br />this time unless the release request is first withdrawn by the permittee. The topsoil berm and site fence will <br />need to be moved to within the new proposed permit boundary, the area to be released reclaimed from the <br />resulting disturbance, and the approved reclamation vegetation will need to be well established and weed-free, <br />before this area will be eligible for release. <br />Although this was not a full site inspection, it was also observed that there was a large area being used to store <br />concrete washout debris (photo 1). It is unknown at this time if this material is being brought in from off-site <br />for recycling, a by-product of on-site activity, used on-site as inert fill, or just being temporarily stored. <br />Because of records recovery issues during the writing of this report, it was unable to be determined if this <br />concrete storage/recycling on-site is in compliance with the approved mining plan. If it is determined that this <br />activity is not accounted for in the currently approved mine plan, the permittee will need to submit a Technical <br />Revision (TR) to modify the mine plan as needed, or remove the material from the site. <br />I & E Contact Address <br />John Bambi <br />Denver Water <br />1600 West 12th Ave <br />Denver, CO 80204-3412
