• <br />The mining plan modification area is not on any Federal lands within the boundaries of <br />any national forest. <br />I have determined that approval of this mining plan modification will not have a <br />significant impact on the quality of the human environment. The Finding of No <br />Significant Impact (FONSI) dated August 13, 2009, is based on the Environmental <br />Assessment Number CO-100-2008-058 EA titled: Peabody Twentymile Coal Company <br />Application for Coal Lease and the FONSI dated June 17, 2008, both prepared by the <br />Bureau of Land Management that describe the impacts that may result from approval of <br />this mining plan modification and its alternatives, and on updated threatened and <br />endangered species and historic preservation assessments. The supporting environmental <br />documents and analyses are included in this decision document. <br />OSM's review of the proposed action did not identify any issues that required resolution <br />via the addition of special conditions to the mining plan modification approval. <br />On July 19, 2009, Twentymile Coal Company published in the Steamboat Pilot the <br />notice of the availability of an administratively complete permit application package. <br />No public comments were received. <br />• On August 16, 2009, Twentymile Coal Company published a newspaper notice in the <br />Steamboat Pilot notifying the public of CO-DBMS' proposed decision. <br />The CO-DRMS determined that $8,039,216.04 is adequate for the total reclamation of <br />Colorado Permit C-1982-056 associated with this mining plan. CO-DRMS currently <br />holds a bond for $8,083,089.00. The bond is payable to the State and the United States of <br />America. <br />A chronology of events related to the processing of the PAP and this mining plan decision <br />is included with the decision document. The information in the PAP, and other <br />information identified in the decision document, has been reviewed by CO-DRMS staff <br />in coordination with the OSM Federal Lands State Coordinator. <br />OSM's administrative record of this mining plan modification consists of the following: <br />- the PAP submitted by Twentymile Coal Company, and updated through <br />August 10, 2009, <br />- the Colorado Division of Reclamation, Mining and Safety's (CO-DRMS) Foidel <br />Creek Mine (Permit No. C-1982-056) Proposed Decision - Technical Revision <br />No. 68 (TR-68) Interim Phase III Development of Western Mining District, <br />0
