-2- <br />Exhibit T Designated Minina Operation (DMO) Environmental Protection Plan (EPP) <br />The Division's Geochemist and Lead Specialist have done a preliminary review of the EPP. The DRMS engineer will <br />submit comments once some requested information is submitted. <br />1) Per Rule 6.4.20(4) please provide a copy of all issued permits noted in Section 3 of the EPP. <br />a) Please identify what dust control measures will be implemented if required by BLM. <br />b) Please note that no signs were observed during the November 10, 2009 pre-operational inspection as <br />required by BLM for hazardous areas and now noted as part of the EPP control measures for exposure. <br />2) Per Rule 6.4.20(6) please provide details procedures that will prevent the spread of radioactive materials <br />outside the confines of the ore storage area during transportation from the portal to the ore pad and during <br />loading operations onto transportation trucks. <br />3) Per Rule 6.4.20(7) a radiological survey is necessary. The proposed plan should be modified to include not only <br />the general permit area survey but also concentrated evaluations of the ore stockpile area, portal, waste dump <br />and ore haulage road to provide adequate baseline date for the EPP. Because this is a site of historical mining <br />this data is paramount to establishing reclamation parameters and the EPP cannot be approved until the <br />quantitative data is supplied and reviewed. <br />4) Please confirm that "gobbing" or underground deposition of waste or low grade ores will not occur where there <br />is any potential for contact with water either introduced or intercepted. <br />5) As noted stormwater run-on diversion structures will be required to remain after reclamation to prevent <br />infiltration of precipitation into waste piles and mine workings. <br />6) Staff notes the engineering certification of the stormwater control structures. However, DRMS engineers must <br />verify calculations for maximum stormwater events and flows in structures. Please provide all data used to <br />determine size and capacities for the stormwater management ditches and retention basins. <br />7) Please identify on Stormwater Plan Map which is retention basin RB-1, RB-2 and RB-3. Also ensure that the <br />map shows clearly internal controls and integration with retention basins not just general flow patterns. <br />8) Please provide engineering and construction details for velocity check structures. <br />Per the submitted EPP: <br />In Section 1.1.2, please note that an alternative to a clay liner for the ore storage area is to commit to excavation and <br />deposition of underlying contaminated materials back into the mine until subsurface radiation levels meet background <br />levels. <br />In Section 9.0 please strike references to the Liberty Mine. The Division reviews each site separately and information on <br />another site is irrelevant and possibly confidential in this case. <br />In Section 10.0 please supply the maintenance and inspection plans for the SWMP. <br />In Section 17.0 please provide as required in Rule 6.20(16) a calculation of the plan growth media (PGM) available for <br />reclamation for stockpiled topsoil, additional undisturbed areas, and analysis of the PGM. <br />In Section 19.0 please reword to note that "if groundwater is unexpectedly encountered the operator will notify DRMS <br />within 10 working days. Under no circumstances will waste or ore rock be deposited underground if there is a potential <br />for water contact."
