III. COMMENTS - COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />and appeared to be stable. <br />Although not part of the SL -4 bond release inspection, an inspection was made at the west side reclaimed portal <br />entries area. As mentioned previously, this area had been excluded from SL -4 due to slope stability issues with <br />the backfilled portals. Cracks and holes were observed in the backfill. In addition, there was an odor of <br />smoldering coal in the immediate area. <br />On the hillside just below this west side unstable area was the origin point for the hillside spring. The <br />temperature of the spring water as it comes out of the hillside has been measured in previous inspections to be <br />about 100 °F. The spring was flowing into its constructed channel and, then, through a buried culvert into the <br />hillside spring water treatment pond. The treatment pond was discharging through a buried culvert to the North <br />Fork of the Gunnison River at about 10 gpm. The spring water was orange in color but has been found in the past <br />tolmeet NPDES and receiving stream standards. <br />Tlie field inspection also provided verification that the sediment control system was in place and was functioning <br />properly. There was no standing water in the sediment pond. The primary discharge pipe's gated valve was <br />closed and the outlet was not blocked. There was no debris in the rip- rapped emergency spillway either. The <br />collection ditch that brings water into the sediment pond was well vegetated and had sufficient capacity. The <br />riverside berm, which protects the facilities area from river flooding, was in place and had sufficient height. <br />General Inspection <br />In addition to the items inspected as part of the SL -4 Bond Release Inspection, other mine site items were <br />examined as part of a normal inspection. <br />The mine identification sign and the "records location" sign were on their posts at the top of the hill. The required <br />information was on the signs. Surface disturbance markers and permit boundary marker signs were up around the <br />site. The paved haul road leading to the mine site was in good condition. The cable guard was securely in place <br />and there was no debris on the road. The bridge over the North Fork of the Gunnison River was passable. The <br />front gate to the reclaimed mine site was open and the "no trespassing" sign was up on the gate. There were no <br />problems noted with the two alluvial wells, AA -1 and AA -3. Both well caps were on. <br />Tannarisk had been removed from the hillside spring water treatment pond but continues to grow in the area of <br />the hillside spring and to the south of the entrance gate. White top was also observed growing at the mine site. <br />The remaining tamarisk and the white top need to be removed. Although not a maintenance item, cheat grass has <br />established itself on the flat facilities area and will need to be dealt with eventually. <br />6 <br />
