III. COMMENTS -COMPLIANCE <br />Eagle Mines C -19 <br />12 Nov 2009 <br />Pg3 /3 <br />Revegetation /Reclamation Success: - The operator did a good job of spraying weeds <br />on the site this past summer. Brian Watterson indicated that they had summer <br />students travel the more remote areas on ATV's performing spot spraying. This extra <br />I <br />ork should pay -off next summer when the weeds begin to grow again. <br />Slides and Damage: - During the inspection, Brian Watterson indicated BTUEC was <br />contracting to have the fuel and oil tanks cleaned out and removed from the site. <br />There are several tanks at the 5A Portal area. When we got to the area of a diesel <br />fuel tank there appeared to be a small fuel spill. The spill area was approximately 3 <br />feet in width by approximately 50 feet in length. The area smelled of diesel fuel. <br />Upon inspecting the area it was noticed that the cap was off the top of the diesel <br />tank. Brian Watterson did not know what had happened but we surmised that the <br />contractor may have been on site and had the spill when they were vacuuming the <br />remaining product out of the tank bottom. BTUEC will need to clean -up this spill <br />immediately. BTUEC will need to perform organic testing of the spill area to <br />determine what was spilled. They will then need to clean the spill area and remove <br />the contaminated soil to an approved landfill. Once the contaminated soil is <br />removed BTUEC will need to again sample the area to verify that all of contaminated <br />soil has been removed. If all of the soil has not been removed, BTUEC will need to <br />continue excavating and removing soil until all the contaminated soil is removed <br />(verifying the complete removal by negative results from the soil testing). The area <br />will then need to be filled and regraded (this may require a revision if material is to be <br />borrowed from another location on the mine site that is not permitted as a borrow <br />area). BTUEC will need to provide a final report of the clean -up to the Division <br />immediately upon completion. This report needs to include, at a minimum, a <br />description of the clean -up activities, all of the lab results (including an explanation <br />of the findings), receipts for the soil disposal and a summary of the reclamation of the <br />area. This information will also need to be included in the appropriate year's Annual <br />Reclamation Report. Please contact the Division if BTUEC has any questions <br />regarding the clean -up. <br />This concludes the 12 November 2009 Inspection report for the Eagle Mine. <br />
