III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This partial inspection of the Carbon Junction Coal Mine was conducted by DRMS staff from the <br />Durango Office at 691 County Road 233, Suite A -2, Durango, CO 81301, phone (970) 247 -5469. No <br />ihdividuals were contacted and no activities were observed during the inspection. One photo <br />accompanies this report. <br />P ublic access to the permit area is controlled by a locked gate at the mine entrance. Evidence of <br />vehicles recently bypassing the gate was not observed. <br />Vegetation continues to establish for all reclaimed areas. <br />The Carbon Junction Diversion appeared intact and capable of functioning as designed. Evidence of <br />recent and /or significant flows in the constructed channel was not observed. <br />As shown in the photo, portions of the East Collection Channel remain intact and not reclaimed. <br />Previously, the East Collection Channel extended north to south through the permit area and routed <br />upland drainage and affected area drainage to the south sediment pond (Pond 1). The south <br />sediment pond has been backfill.ed. Likewise, approximately 1,300 feet of the lower reach of the East <br />Collection Channel has also been backfilled. However, there exist approximately 2,000 feet of East <br />Collection Channel still intact, but with no outlet. The remaining portion of the East Collection Channel <br />O s potential to deliver concentrated drainage to the upland side of the mine entrance road at a <br />section of the road which is not protected by a culvert. The remaining portions of the East Collection <br />Channel appear to occupy a topographic low where drainage will concentrate even if the ditch were <br />I <br />losed by backfill. Therefore, the installation of a new culvert, under the mine entrance road and at a <br />location nearby Topsoil Stockpile 7, appears prudent to ensure the long term stability of the mine <br />entrance road. <br />
