Re: Montoya Pit, ermit M-1980-146, Amendment AM-4, Adequacy Review Letter.
Dear Mssrs. Barton and Gilleland,
This office has reviewed the materials that were submitted toward Amendment 4 of the above-named permit, and in
response to the Division's September 23, 2009 adequacy review letter. At this time we have the following comments
and questions, which should be addressed before the decision date. Items listed below as being adequate, or not
appearing on the list, do not need to be addressed further.
Exhibit C - Minting Maps (Rule 6.4.3)
These are adequate at this time. In the future, should there be a need to revise the sequence or boundaries of the
phases, this may be accomplished via a technical revision.
Exhibit E - Reclamation Plan (Rule 6.4.5)
This office has a concern with the slope gradients within the reclamation plan, specifically in the eastern area that is
presently part of Permit M-2008-048, which is being added under this amendment. The final slopes in that specific
portion of the Montoya Pit permit that, are proposed are too steep to be adequately stabilized, given the final road to be
located in this area, the height of the cut slope above the road, and the deep fill and drainageway below the road.

Exhibit F - Reclamation Maps (Rule 6.4.6)
These are adequate at this time. However, there may be changes to the Reclamation Plan (above) which might require
revising the details shown on the reclamation maps.
Exhibit N - Proof of Right-of-Entry (Rule 6.4.14)
This exhibit is not adequate. Though documents provided adequately demonstrate right-of-entry for activities on
Gilleland-owned lands, it has not been documented for the BLM-managed lands.
