M <br />(e) state the average thickness of replaced topsoil by reclamation area or phase. <br />Some modification to the scale of the Reclamation Plan Map may be required to show the above in <br />adequate detail. <br />EXHIBIT L - Permanent Man -Made Structures (Rule 6.3.12): You must provide information sufficient to <br />demonstrate that the stability of any structures located within two hundred (200) feet of the operation or affected <br />land will not be adversely affected. If the Office determines that such information is inadequate to demonstrate <br />that the operation will not adversely affect the stability of any significant, valuable or permanent man -made <br />structure, the Applicant shall either: <br />(a) provide a notarized agreement between the applicant and the person(s) having an interest in the <br />structure, that the applicant is to provide compensation for any damage to the structure; or <br />(b) where such an agreement cannot be reached, the applicant shall provide an appropriate engineering <br />evaluation that demonstrates that such structure shall not be damaged by activities occurring at the <br />mining operation. <br />(c) Where such structure is a utility, the applicant may supply a notarized letter, on utility letterhead, <br />form the owner(s) of the utility that the mining and reclamation activities, as proposed, will have "no <br />negative effect" on their utility. <br />If there are any structures within 200' of the permit boundary — even if they are currently owned by the <br />property owner /operator - a damage waiver agreement between operator and owner should be <br />submitted in accordance with section (a) above. If there are no structures within 200' of the permit <br />boundary please state that in this section. <br />Additional Information <br />Please provide the Division with proof of public notice publication consisting of a copy of the public notice published, <br />and verification of place and date of publication so that we can determine the appropriate required public comment <br />period. Also, letters from other commenting agencies /entities received to date have been included with this <br />correspondence for you to review. <br />This concludes the Division's preliminary adequacy review of this application. Other issues may arise as additional <br />information is supplied. Please remember that the decision date for this application is December 18, 2009. As previously <br />mentioned, if you are unable to provide satisfactory responses to any inadequacies prior to this date, it will be your <br />responsibility to request an extension of time to allow for continued review of this application. If there are still <br />unresolved issues when the decision date arrives and no extension has been requested, the application will be denied.
