Updated mining and <br />reclamation plan. <br />The terms of the Amendment No. 2 approved by the Division are hereby incorporated into Permit No. M -1987 -049. <br />The conditions of the Division approval are noted below. Please note that all other provisions of Permit No. M- 1987 -049 <br />remain in full force and effect. <br />Stipulation: <br />Ready Mixed Concrete Company shall not disturb the McCann Ditch and land within 200 feet of the McCanne <br />Ditch until they have submitted and received approval from the Division of a Technical Revision with plans for <br />the French Drain System. * ** The Technical Revision shall contain engineering plans and details about the <br />location of the French Drain System that will be installed to transmit groundwater to the ditch to maintain the <br />groundwater regime supplying the ditch. Also, the operator will need to post sufficient financial warranty to <br />cover the cost of the installation of the French Drain System. <br />W0 <br />The operator will need to submit and receive approval of a Technical Revision showing the French Drain System <br />is not necessary. <br />** *This stipulation shall not apply to areas mined adjacent to the McCanne Ditch originally permitted for <br />relocation under the existing and currently approved mining and reclamation plan. * ** <br />The revised estimated liability amount of $4,168,740.00 exceeds the $136,688.00 performance bond currently held. If <br />you have not already done so, please submit additional bond in the amount of $4,032,052.00. The additional financial <br />warranty must be submitted by January 15", 2010.
