Dear Mr. Timmons DI:
On November 12, 2009 the Division of Reclamation, Mining and Safety approved the Amendment application submitted
to the Division on March 19, 2009, addressing the following:
Addition of 115.3 acres to the permit area for a total permit area of 287.8 acres. Updated mining and
reclamation plan.
The terms of the Amendment No. 2 approved by the Division are hereby incorporated into Permit No. M -1987 -049.
The conditions of the Division approval are noted below. Please note that all other provisions of Permit No. M- 1987 -049
remain in full force and effect.
Stipulation:
Ready Mixed Concrete Company shall not disturb the McCann Ditch and land within 200 feet of the McCanne
Ditch until they have submitted and received approval from the Division of a Technical Revision with plans for
the French Drain System. * ** The Technical Revision shall contain engineering plans and details about the
location of the French Drain System that will be installed to transmit groundwater to the ditch to maintain the
groundwater regime supplying the ditch. Also, the operator will need to post sufficient financial warranty to
cover the cost of the installation of the French Drain System.

The operator will need to submit and receive approval of a Technical Revision showing the French Drain System
is not necessary.
** *This stipulation shall not apply to areas mined adjacent to the McCanne Ditch originally permitted for
relocation under the existing and currently approved mining and reclamation plan. * **
The revised estimated liability amount of $4,168,740.00 exceeds the $136,688.00 performance bond currently held. If
you have not already done so, please submit additional bond in the amount of $4,032,052.00. The additional financial
warranty must be submitted by January 15", 2010. The revision will not be final until the bond is approved by the
Division.
