(Page 2) <br />MINE ID # OR PROSPECTING ID #: -m-1222-QA <br />INSPECTION DATE: 1 ]./4-409 INSPECTOR=S INITIALS: MAC- <br />OBSERVATIONS <br />The inspection was conducted by Michael Cunningham of the Division of Reclamation, Mining and Safety <br />(Division). Brad Janes of Varra Companies was also present for the inspection. The Kurtz Resource Recovery <br />and Land Development Project site is located approximately 1.5 miles from Mead, Colorado. The site is <br />permitted for 295.40 acres, with a Maximum Allowed disturbed area of 85.20 acres. <br />Following the inspection conducted on July 24, 2009, the Division recalculated the amount of Financial <br />Warranty required to complete reclamation. The Division's calculations estimated the cost to reclaim the site to <br />be $2,486,383.00. This is an increase of $2,427,583.00 over the $58,800.00 currently held by the Division. The <br />Operator submitted Technical Revision - 02 on October 5, 2009. The Technical Revision revised the Mining <br />Plan to allow for the creation of two reservoirs, instead of four reservoirs as specified in the original permit <br />application. The requested change in the Mining and Reclamation Plans reduced the Operator's reclamation <br />responsibility. Therefore, the Division will recalculate the Financial Warranty amount to account for the <br />changes to the Mining and Reclamation Plans. The Technical Revision also stated that the Operator had <br />conducted additional reclamation activities following the previous inspection. The purpose of this inspection <br />was to verify that the stated reclamation had been completed in order to revise the Division's Financial <br />Warranty calculation. <br />Upon completion of reclamation, the Kurtz site will contain two basins. Basin A and Basin B will result in <br />115.85 acre and 37.17-49.52 acre reservoirs respectively. At the time of the inspection no mining had taken <br />place in Basin B. Basin A is currently divided into east and west cells. Grading has been completed along the <br />southern and western pit slopes in the west cell of Basin A. The east pit slope will be mined through to connect <br />the west and east cells of Basin A. The northern pit wall of Basin A has been mined through to connect Basin A <br />to what was formerly identified as Tract ITI.
