Cattany <br />Twentymile Coal Company Division Director <br />Natural Resource Trustee <br />29515 Routt County Road 27 <br />O ak Creek, CO 80467 <br />Ite: Foidel Creek Mine (Permit No. C- 1982 -056) <br />Proposed Decision - Technical Revision No. 67 (TR -67) <br />Expansion of Coal Refuse Disposal Area <br />D ear Mr. Nettleton: <br />Enclosed you will find the Division of Reclamation, Mining and Safety's Proposed Decision for Technical <br />Revision No. 67 at the Foidel Creek Mine. Notice of the proposed decision will be published in the <br />Steamboat Pilot as soon as possible. The first publication will initiate the ten (10) day public comment <br />I for the Division's decision. <br />The Division proposes to approve the design of the Refuse Disposal Area expansion. The pile <br />expansion will be constructed in three (3) increments. TCC is proposing incremental bonding for these <br />three increments as - Initial bond, Increment I and Increment 11, in accordance with Rule 3.02.1(6). <br />Twentymile Coal Company proposes to bond for the first increment, Initial Bonded Disturbance, with <br />approval of this revision. Only disturbance associated with the Initial Bonded Disturbance shall occur <br />u pon the Division's approval of bond submitted by the operator. <br />The design Refuse Disposal Area Expansion is proposed to encompass 140.0 acres. The Initial Bonded <br />Disturbance shall be limited to 50.0 acres. Prior to any additional disturbance in bonding Increment I <br />o r bonding Increment II, the operator shall submit a minor revision detailing the additional disturbance <br />area and associated bond. <br />Documentation must be submitted to the Division demonstrating that a copy of the approved revision <br />I <br />pplication was sent to the Office of Surface Mining and the Bureau of Land Management. The material <br />should be sent within 15 days of final approval. <br />P lease refer to the Performance Bond heading on the enclosed proposed decision form. If the amount of <br />B ond Held equals or exceeds the Revised Liability, you need not submit additional bond.
