BEFORE; THE MINED LAND RECLAMATION BOARD <br />STATE OF COLORADO <br />ORDER <br />IN THE :MATTER OF COLORADO STONE QUARRIES, INC., REQUEST FOR AN <br />EXTENSION OF TIME TO COMPLETE BOARD ORDERED COMPLIANCE FOR MV- <br />2009-023, File No. M-1999-058 <br />TEIIS MATTER came before the Mined Land Reclamation Board ("Board") on <br />October '7, 2009 in Denver, Colorado for a hearing on a request from Colorado Stone <br />Quarries., Inc. (the "Operator") for an extension of time to complete the Board ordered <br />corrective actions for MV-2009-023. The file number is M-1999-058. Denis Doucet <br />appeared on the Operator's behalf. Russ Means appeared on behalf of the Division of <br />Reclamation, Mining and Safety ("Division"). <br />The Board, having considered the parties' presentations and testimony and having <br />been otherwise fully informed of the facts, hereby enters the following findings and order. <br />FINDINGS <br />1. The Board has jurisdiction over this matter pursuant to §§ 34-32.5-104 through <br />107, and 124 of the Colorado Land Reclamation Act for the Extraction of Construction <br />Materials, §§ 34-32.5-101 through 125, C.R.S. (the "Act"). <br />2. The Operator holds a Section 110c construction materials reclamation permit <br />for the Yule Marble Quarry, permit number M-1999-058. The permit area is 6.7 acres and is <br />located in Section 1, Township 12 South, Range 88 West, 6th Principal Meridian, in <br />Gunnison County, Colorado. The site is located approximately three miles southeast of the <br />town of Marble, and above the Yule Creek. Marble is quarried from the underground quarry <br />operation. <br />3. The Board originally heard this matter in August 2009. The Board found the <br />Operator in violation of the Act for failing to minimize disturbances to the prevailing <br />hydrologic balance', MV-2009-023. <br />I The Board Order was signed and effective on September 4, 2009. On the same day, the Board issued a separate <br />Board Order, MV-2009-024, finding another violation against the Operator for failing to protect areas outside of the <br />affected land from slides or damage occurring during the mining operation and reclamation. <br />Colorado Stone Quarries, Inc. <br />Yule Marble Quarry <br />Order Granting Extension of Time <br />MV-2009--023, File No. M-1999-058
