' • _ Divi&n of Reciarnation', <br />Mining and Safety <br />Dear Mr. Vallerine: <br />We received your letter dated October 21, 2009, which contains the Bureau of Land Management (BLM) <br />requested information to support your original notice submitted on July 31, 2009. The additional information <br />related to drill hole location, associated disturbances, access and schedule appear to be sufficient to meet standard <br />federal regulations pertaining to exploration (43 CFR 3809.301). Based on this information, the BLM was able to <br />conduct site visits on November 3, 2009 and November 9, 2009. <br />Due to the snow cover encountered during the November 3rd site visit, it was difficult to assess if there were any <br />concerns regarding archeological sites or sensitive species in the area. Therefore, the area surrounding proposed <br />borings 1, 2 and 3 was reevaluated on November 9th, after the ground surface was visible. It was determined at <br />that time that there were no conflicts with archeological sites or sensitive species for any of the six locations <br />where the drill holes are currently being proposed. <br />Our office has also coordinated with the Colorado Division of Reclamation, Mining and Safety (CDRMS) <br />regarding the warranty calculation associated with this proposed project. The financial assurance required by <br />CDRMS will include the proposed work on federal lands. Prior to conducting this work, Black Range Minerals is <br />required to list BLM on the bond. <br />Per 43 CFR 3809.301(b)(1), the taxpayer identification number for the operator is also required for a notice to be <br />considered complete. This information was not provided in the original or follow-up submittals provided to the <br />BLM.
