DEPARTMENT OF NATURAL RESOURCES
DIVISION OF WATER RESOURCES
md?
Bill Ritter, Jr.
Governor
Harris D. Sherman
Executive Director
Dick Wolfe, P.E.
Director/State Engineer
Response to Reclamation Permit Application Consideration
DATE: November 10, 2009
TO: David A. Bird, Environmental Protection Specialist s,
CC: Division 1 Office, District 2 Water Commissioner No`yr
FROM: loana Comaniciu, P.E. RE: 120 Estates Sand and Gravel Mine, File No. M-2001-085-AM
Operator: Les Ewegen, LLC (303) 667-1666
Contact: Les Ewegen-(303) 667-1666
Section 35, Twp 1 South, Range 67 West, 6th P.M., Adams County
CONDITIONS FOR APPROVAL
? The proposed operation does not anticipate exposing groundwater. Therefore, exposure of
ground water must not occur during or after mining operations.
® The purpose of this amendment is to change the current mining plan from a slurry wall liner
around the perimeter of the site to a clay liner. The slurry wall has been completed; however,
tests have indicated that there is a leak in the liner. The mining operation will still consume
ground water by: N evaporation, Nreclamation, N water removed in the mined product, N
other: dewatering.
N According to our records, on August 31, 2009 the State Engineer's Office received a request
for temporary substitute water supply plan ("SWSP") for the 120 Estates Sand and Gravel
Mine site and this request is pending evaluation. A well (gravel pit) permit was approved for
this site under permit no. 57723-F. With the proposed amendment, the applicant will need to
ensure the water consumption by the gravel operation at the 120 Estate Sand and Gravel
Mine is included in the pending SWSP. The applicant will need to amend its SWSP request if
the proposed uses are not included in the current SWSP for the 120 Estates Sand and Gravel
Mine Pit.
COMMENTS: If storm-water runoff is intercepted by this operation and is not diverted or captured in
priority, it must be released to the stream system within 72 hours. This may require a discharge
permit from CDPHE-WQCD. Otherwise, the operator will need to make replacements for
evaporation.
The applicant may contact the State Engineer's Office with any questions.
Office of the State Engineer
1313 Sherman Street, Suite 818 • Denver, CO 80203 • Phone: 303-866-3581 • Fax: 303-866-3589
www.water.state.co.us
