Noncomoliance Notification <br />If the permittee does not comply or will be unable to comply with any <br />discharge.limitations, standards or permit requirements, the Water Quality Control <br />Division of CDPHE and EPA are to be notified with the following information: <br />Section A <br />1. Description of the discharge and cause of noncompliance <br />2.. The period of noncompliance, including exact dates and times and/or the <br />anticipated time when the discharge will return to compliance; and <br />3. Steps taken to reduce, eliminate and prevent recurrence of the noncompliance <br />discharge. <br />The following instances of noncompliance shall be reported orally within 24 hours <br />from the time the permittee becomes aware of the noncompliance and shall provide <br />a written report within 5 days to the Water Quality Division of CDPHE. <br />Section B <br />1. Any instance of noncompliance which may endanger health or the environment <br />2. Any unanticipated bypass which exceeded effluent limitation <br />.3. Any upset which causes an excess of any effluent limitation <br />4. Any spill which causes any effluent limitation to be violated <br />5. Daily maximum violations for any toxic pollutants or hazardous substances.. This <br />includes any toxic pollutant or hazardous substance or any pollutant specifically <br />identified as the method to control any toxic pollutant or hazardous substance. <br />All other instances of non-compliance will be disclosed on the Discharge Monitoring <br />Report outlined in Section A of the above. <br />8
