III. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the <br /> inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br /> evidence supporting the enforcement action. <br /> This was a partial inspection conducted by Joe Dudash of the Colorado DRMS.No one represented the Terror <br /> reek Qompa*y during the inspection. <br /> acilities <br /> Repair work was underway on part of the coal handling structures so no unloading of coal cars or loading of <br /> railcars was in progress. There was a moderate volume of raw coal that was stockpiled on the facilities bench.A <br /> few loaded railcars and a few empties were on site. There was a moderate wind blowing but no signs of fugitive <br /> dust were observed. <br /> There were no problems at the loadout office, substation,material storage area, facilities bench and railroad <br /> track area.There were no fuel leaks at the fuel facility. <br /> Hydrology <br /> There was only a little standing water in the east side sedimentation pond. The gated valve on the primary <br /> discharge pipe was in the closed position. There was no blockage in the pond's riprapped,open channel <br /> emergency spillway. The pond inslopes and outslopes were stable. The embankment was well vegetated.The <br /> west side dugout pond was dry. The combination spillway was clear of any debris. <br /> The loadout ditches had sufficient capacity. The straw bales and silt fence that are situated around the inlets of <br /> the railroad culverts, as part of the railroad track small area exemption,were in place. The berm was up on the <br /> outer edge of the facilities bench. <br /> Topsoil Stockpiles <br /> The east side topsoil stockpile had a moderate vegetative cover. The topsoil signs were up. The collection and <br /> diversion ditches were functional. The west side topsoil stockpile had a good vegetative cover. Topsoil signs <br /> were up on this stockpile as well. The stockpile's collection ditch/berm was in place. <br /> Signs and Markers <br /> The mine identification signs were up at the main entrance,next to the gate at the east side entrance and near the <br /> intersection of the east side road and the railroad tracks. The required information was on the signs.Permit <br /> boundary markers were up around the permit boundary. <br /> Roads <br /> The paved entrance road off of the main highway was in good condition. The guard rail was up.At the east <br /> entrance,the graveled road was in good condition too. The light use road along the railroad tracks was passable. <br /> c:/word2007/terror/insp 1109 <br />
