1 <br />6.4.19 EXHIBITS- Permanent Man-Made Structures <br />26.) There are several structures located within 200 feet of the affected land, such as a <br />power line, a fence, a residence and several sheds along the southern portion of the <br />permit area. In accordance with Rule 6.4.19, when mining operations will adversely <br />affect the stability of any significant, valuable and permanent man-made structure <br />located within 200 feet of the affected area, the applicant may either: <br />a.) Provide a notarized agreement between the applicant and the person(s) <br />having an interest in each of the structures, that the applicant is to provide <br />compensation for any damage to the structure; or <br />b.) Where such an agreement cannot be reached, the applicant shall provide an <br />appropriate engineering evaluation that demonstrates that such structure shall <br />not be damaged by activities occurring at the mining operation. <br />c.) For the power line, you may supply a notarized letter, on utility letterhead, <br />from the owner(s) of the utility that the mining and reclamation activities as <br />proposed, will have "no negative effect" on their utility. <br />Please provide evidence (certified letter to structure owners) that a notarized <br />agreement between the structure owners and the applicant was pursued or, in lieu of <br />reaching these agreements, the Office will consider the Geotechnical Stability Exhibit <br />submitted for Exhibit U. <br />27.) According to Exhibit L, County Lane 15 will be diverted around the east side of the <br />mine site. Also it appears County Road 13 enters the mine site from the west. These <br />roads are not accounted for in Exhibit S. The operator will need to attempt to obtain <br />the proper damage agreement discussed above. If such an agreement cannot be <br />reached, these structures will need to be accounted for in the Geotechnical Stability <br />Exhibit. Also, please provide evidence that the County approves the re-location of <br />County Lane 15. <br />Other Issues: <br />28.) The Division of Water Resources sent the Division a letter concerning the proposed <br />mining operation; it outlines the parameters you must follow in regards to the exposure <br />of ground water and impounded storm water. Their correspondence is enclosed with <br />this letter. Please commit to complying with these standards. <br />29.) The Office of Archaeology and Historical Preservation sent the Division a letter <br />concerning the Lake Meredith Outlet Ditch. Their letter indicated the ditch is within the <br />project area. The Exhibit C-1 map may show the ditch; however, it is not labeled. The
