2.03.12 Newspaper Advertisement and Proof of Publication
<br />The following is the form of the newspaper advertisement used for the permit
<br />transfer:

<br />Bowie Resources, LLC, P.O. Box 1488, Paonia, CO 81428, has submitted a request for
<br />transfer of a coal permit and succession of operators to the Division of Minerals and
<br />Geology for the Bowie No. 1 Mine, mining permit No. C-81-038. The request for transfer
<br />includes a revision of the identification of interests section of the permit. Bowie
<br />Resources Limited is the current permittee and has agreed to transfer the permit to
<br />Bowie Resources, LLC.
<br />The Bowie No. 1 Mine is located in Delta county, approximately four (4) miles north of
<br />Paonia, CO. The Bowie No. 1 Mine loadout is located in Delta county approximately
<br />one mile east of Paonia, CO south of State Highway 133. The surface facilities, located
<br />north of the North Fork of the Gunnison River, are located in portions of Sections 23
<br />and 24, Township 13 South Range 92 West; and Section 29, Township 13 South,
<br />Range 91 West of the 6th P.M. The mine permit area is located on the U.S. Geological
<br />Survey 7.5 minute Bowie and Gray Reservoir, Colorado Quadrangle maps within the
<br />following sections.

<br />Sections: 1, 2, 10, 11, 12, 13, 14 15, 22, 23, 24 and 25
<br />Township 13 South. Range 91 West. 6`" P.M.
<br />Sections: 5, 6, 7, 8, 17, 18, 19, 29, 30, 31, and 32
<br />containing 8,089 acres more or less.

<br />A copy of the revised identification of interests section of the permit and the transfer
<br />request is available for public inspection at the Paonia Public Library, 140 Grand Avenue,
<br />Paonia, CO, and at the offices of the Division of Minerals and Geology, 1313 Sherman
<br />St., Room 215, Denver, CO, 80203, (303) 866-3567. Written comments regarding this
<br />application may be submitted to and additional information may be obtained from the
<br />Division of Minerals and Geology at the above address. Any person whose interests are
<br />or may be adversely affected, including, but not limited to, the head of any local, State, or
<br />Federal government agency, may submit written comments on the application for
<br />approval to the Division of Minerals and Geology, within 15 days of this newspaper
<br />notice.
