2.03.6 Right of Entry and Operation Information <br />Bowie Resources, LLC, purchased the assets of Bowie Resources Limited <br />effective December 31, 2003. Thus, the right of entries described below for <br />Bowie Resources Limited were transferred to Bowie Resources, LLC. <br />Bowie Resources Limited transferred to Bowie Resources, LLC all of its right <br />title and interest to all of the real property it owned in Delta County. This <br />transfer was in the form of a Special Warranty Deed dated December 31, <br />2003 and recorded at reception number R575229 in the Delta County <br />Records. Private leases, rights of way and other private agreements are <br />transferred through successor in interest clauses. Bowie Resources Limited <br />assigned all of its Federal Coal Leases and Federal Rights of Way to Bowie <br />Resources, LLC. The Federal Coal Leases and Federal rights-of-way require <br />approval from the Bureau of Land Management. The BLM approved <br />assignment of the Federal rights-of-way through its decision dated March 5, <br />2004. The BLM approved assignment of the Federal Coal Leases through its <br />decision dated February 4, 2005. Land use permits and highway access <br />permits go with the land so no transfer is required. <br />• <br />(1) The deeds, leases, easements and rights-of-way listed and described <br />below grant Colorado Westmoreland Inc., the predecessor to Bowie <br />Resources Limited, predecessor in title, the legal right to enter and <br />begin underground mining activities in the permit area. None of the <br />legal interests involved are presently the subject of litigation and none <br />of the easements or leases are temporary. Permanent leases and <br />property have been acquired in order for the mining and reclamation <br />plan to be feasible. In addition, a consent agreement between CWI <br />and Jerry Morrell, executor of the D.R. Morrell estate, has been <br />acquired granting CWI access on his property in orderto comply with <br />applicable mining and reclamation laws. See the agreement in the <br />Land Use Appendix, Volume 9. Other than Federal (BLM) and CWI <br />properties, the D.R. Morrell property is the only land which will be <br />undermined during the initial permit term. <br />Deeds (lands now owned in fee simple by Bowie).
