Cattany <br />RE: Bowie No. 2 Mine, Permit No. C-96-083, Bowie Resources LLC Division Director <br />Technical Revision No. 64, Increase Height of Coal Refuse Pile No. 4, Second AdequacytM8Wrce Trustee <br />Dear Mr. Bear: <br />The Colorado Division of Reclamation, Mining and Safety (Division) has fmished its review of Bowie <br />Resources LLC's (BRL) submittal dated October 1, 2009 for Technical Revision No. 64 (TR-64). The <br />following is the resolution status of the Division's questions and comments. Please note that questions nos. 8 <br />and 28 remain unresolved and comment no. 16A, the reclamation cost estimate calculation, has been added. <br />Geotechnical Review <br />Page x of Volume IX (the Table of Contents) should be revised to include the Buckhorn Geotech <br />report dated 18 May 2009. <br />The Division has no further concerns. The October 1, 2009 submittal contained revised page x that <br />included the geotechnical report. <br />2. The current version of Volume IX includes a November 2003 certification, signed by J. E. Stover, <br />which references the Lambert and Associates stability analyses. This item should be updated to <br />reflect the additional stability analyses conducted by Buckhorn Geotech. <br />The Division has no further concerns. The October 1, 2009 submittal contained the updated <br />certification for Volume IX. <br />Replacement pages I thru 14 of Volume IX were submitted with the application for TR-64. Not all <br />of these pages have been revised. For clarity, only those pages that are being changed with this <br />revision should be included. <br />The Division has no further concerns. Only revised pages 1, 3, 4, 11, 13 and 14 of Volume IX <br />were provided in the October 1, 2009 submittal. <br />On Page 4, first paragraph, the maximum height for CMWDA-2 is provided. Please include a <br />description of the maximum height proposed for CMWDA-4. <br />The Division has no further concerns. A reference to a maximum height of 150 feet was added to <br />page 4 of the October 1, 2009 submittal. <br />The last sentence of the second paragraph on Page 4 refers to "the following Lambert & <br />Associates report. " According to page x, Volume U-includes three Lambert reports.
