Compliance Advisory Responses <br />October 28, 2009 <br />Page Two <br />During the construction process there was insufficient water observed in the gulch for sampling. This <br />was independently verified by DRMS during a recent inspection. Based on my last observations, there <br />are no surface seeps to sample/monitor. If surface seeps are observed at any time in the future they <br />will be sampled and tested. <br />Given the intent expressed, and measures taken to date, we respectfully request that CDPHE will allow <br />us to continue with the process of determining water quality in the gulch below our permitted <br />workings. We fully intend to take the sampling/testing measures required by your "Order" and move <br />quickly toward obtaining a discharge permit. <br />I hope this response adequately addresses your concerns.
