LKA Inlernallonal, Inc. <br />Golden Warder Anne <br />Compliance Advisory <br />Page 3 of 3 <br />Pursuant to §25-8-608, C.R.S., any person who violates a Notice of Violation/ Cease and Desist <br />Order shall be subject to the imposition of civil penalties. The Division is authorized to impose a <br />penalty of up to $10,000 for each day that LKA violates, and continues to violate, the requirements <br />of the Order. Therefore, and to potentially reduce the penalties described above, LKA is strongly <br />encouraged to provide the required written response to paragraphs 23, 25 and 26 of the Order <br />immediately but no later than October 30, 2009. <br />Please be aware that LKA is responsible for complying with the Water Quality Control Act and that <br />there are substantial penalties for failing to do so. This Compliance Advisory is intended to advise <br />you of possible violations of the Colorado Water Quality Control Act and its implementing <br />regulations so that you may take appropriate steps to avoid or mitigate additional formal <br />enforcement actions. The issuance of this Compliance Advisory does not limit or preclude the <br />Division from pursuing its enforcement options concerning the above violation(s). The Division is <br />currently evaluating the facts associated with the above-described violation(s) and, if deemed <br />necessary, LKA may be subject to an escalated enforcement response, which may include judicial <br />actions and/or the imposition of additional penalties. Any information that you submit will -be <br />considered in the Division's review of this matter.
