Box 670 <br />Hayden, CO 81639 <br />RE: Retention of Permanent Features/structures <br />Seneca Coal Company, <br />Seneca Coal Company (SCC) is in final stages of reclamation at the Yoast mine. SCC has applied for a Phase I <br />Reclamation bond release on a portion of the mined and reclaimed area. SCC will proceed with bond release <br />requests for the remainder of the area in the near future, including the following features listed below: <br />• Access roads <br />• Light use roads <br />• Water well <br />• Power line and substation <br />• Fenced shrub plots <br />• Sediment ponds <br />• Stock ponds <br />• SCC will apply for release of the bond held by the Colorado Division of Reclamation, Mining and Safety. The first <br />step is to obtain a letter from the landowner requesting that the feature/structure be left as permanent. This step <br />is in accordance with the Colorado Mined Land Board Regulations for Coal Mining: <br />• Rule 2.05.5 (11(b). the postmining land use description shall be accompanied by a copy of the comments concerning the proposed <br />use by the legal or equitable owner of record of the surface of the proposed permit area and the State and local government agencies <br />which would have to initiate, implement, approve, or authorize the proposed use of the land following reclamation. <br />If you have any questions, please contact Roy Karo at (970) 276-5217 or 846-3648, otherwise we request that you <br />sign one copy of the attached request letter and return it to Seneca Coal Company in the self addressed stamped <br />envelope.
