18.2 Lessee agrees that the Lessor shall be under no obligation of any kind or nature <br />whatsoever to maintain the Airport in any particular condition, and Lessee hereby <br />agrees that he waives all claims for damages of any kind or nature resulting from <br />this use. <br />18.3 Article and section headings shall not be deemed to govern, limit, modify or in any <br />manner affect the scope, meaning or intent of the provisions of this Lease. <br />18.4 The provisions of the Lease shall be construed as to their fair meaning, and not for <br />or against any party based upon any attributes to such party of the source of the <br />language in question. <br />18.5 The Lessee shall perform all terms and conditions of the Lease in strict compliance <br />with all applicable laws, rules, charters, ordinances and regulations, as now exist or <br />are later enacted or amended, of the Lessor- except any future ordinances or <br />regulations adjusting or establishing lease rates - and all county, state and federal <br />entities having jurisdiction over the Airport, the Premises, or the Lessee's <br />operations. <br />18.6 No representations, warranties, or certifications, express or implied, shall exist as <br />between the parties, except as specifically stated in the Lease. <br />18.7 None of the terms, conditions or covenants in the Lease shall give or allow any <br />claim, benefit, or right of action by any third person not a party hereto. Any person <br />other than the Lessor or the Lessee receiving services or benefits under the Lease <br />shall be only an incidental beneficiary. <br />18.8 The Lease is an integration of the entire understanding of the parties with respect <br />to the matters stated herein. The parties shall only amend the Lease in writing with <br />the proper official signatures attached thereto. <br />18.9 Invalidation of any specific provision of the Lease shall not affect the validity of any <br />other provision of the Lease. <br />18.10 The Lease shall be governed and construed according to the laws of the State of <br />Colorado. <br />18.11 This Lease shall extend to and be binding upon the heirs, successors, and assigns <br />of the parties. <br />(Revised 1-15-03) 2.05.4(2)(e) - 57
