III. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the <br /> inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br /> evidence supporting the enforcement action. <br /> This was a complete inspection conducted by Joe Dudash of the Colorado DRMS.Bill Bear represented the <br /> operator during the records check. There was no representative present during the field inspection. <br /> Roads <br /> The paved entrance road was clear of debris and was passable.The cable guard was in place on the outside edge <br /> of the entrance road.The bridge across the river was passable. <br /> Signs and Markers <br /> The mine sign was on its post at the top of the hill at the entrance. Surface disturbance markers were up around <br /> the disturbed area,except on the hillside where placement might have been unsafe due to the terrain.The"no <br /> trespassing"sign was on the entrance gate. <br /> Hydrology <br /> The hillside spring water treatment pond was discharging into the river at about 10 gpm. The color of the <br /> discharge water was orange,which has been found to be in compliance with water quality standards.The water <br /> level in this treatment pond was about 8 inches below the level of the horizontal pipe. There was no water in the <br /> sediment pond.The sediment pond's primary discharge gate was closed. The riprapped emergency spillway was <br /> clear of any obstructions. <br /> The collection ditch leading into the sediment pond had sufficient capacity and had a moderate vegetative cover. <br /> The culvert at the mine site entrance gate was clear.The caps were on both of the alluvial wells.The riverside <br /> berm was in place and had sufficient height.The hillside spring was flowing into its constructed channel and <br /> through the culvert that leads into the treatment pond.The temperature of the spring water was measured at 100 <br /> degrees Fahrenheit at a point that was about 10 feet below the spring's origin on the hillside. <br /> Reclamation <br /> The reclaimed fan and portal access road was well vegetated and appeared to be stable.The reclaimed fan area <br /> was also well vegetated and did not exhibit any signs of slope instability or erosional problems.However,the <br /> backfilled and graded portal entries area on the west side continue to show signs of instability. There was also a <br /> scent of smoldering coal coming from this area. <br /> The debris near the reclaimed mine office has been removed and the last of the concrete sections have been <br /> removed as well. However,there still remains some pipe and metal east of the former office area and a grate <br /> section on top of the riverside berm northeast of the former office area. <br /> Noxious Weeds <br /> The tamarisk has been cut down at the hillside treatment pond. Some tamarisk is still growing at the hillside <br /> spring area and along the fence at the entrance gate.This tamarisk needs to be removed as well. <br /> Records <br /> All of the required records were located at the Bowie No.2 Mine,as shown on the attached checklist. <br /> c:/word2007/bear3/insp 1009 <br />
