III. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the <br /> inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br /> evidence supporting the enforcement action. <br /> This was a complete inspection conducted by Joe Dudash of the Colorado DRMS.Jim Kiger represented the <br /> operator during the field inspection and records check. There was no activity at the loadout. <br /> Roads <br /> The paved main entrance road off of the highway was in good condition,with the guard rail in place.There was <br /> a little coal dust that had been tracked onto the highway but it was not a problem. The east entrance gravel road <br /> also was in good condition.The gate was open.The light use road that runs along the railroad tracks was dry. <br /> Signs and Markers <br /> Perimeter markers were found around the permit boundary.Mine identification signs were up at the main <br /> entrance,east entrance and near the railroad tracks. The signs contained the required information. <br /> Hydrology <br /> There was a little standing water in the east side pond.The pond's gated primary valve was closed and the <br /> emergency spillway was clear of any blockage. The pond's embankment had a good vegetative cover.Pond <br /> inslopes were stable. The west side dugout pond was dry.The combination spillway was functional. <br /> The culverts and ditches that bring runoff into the east side pond were clear of debris and had sufficient <br /> capacity.The railroad track small area exemption silt fence and straw bales were in place. <br /> Topsoil <br /> The topsoil stockpile on the east side of the loadout was well vegetated.The collection ditch and the diversion <br /> ditch were in place.Topsoil signs were up. The topsoil signs were also up on the west side topsoil stockpile. <br /> This topsoil stockpile also had a good cover of vegetation. The collection ditch was in place. <br /> Facilities <br /> There was only a small volume of coal that had been stockpiled on site. Several filled and empty railcars were <br /> on site.There was no problem with fugitive dust.There were no problems with the facility structures. <br /> Records <br /> The required records were at the loadout office.Please refer to the attached records checklist. <br /> c:/word2007/terror/insp 1009 <br />
