III. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the <br /> inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br /> evidence supporting the enforcement action. <br /> This was a partial inspection conducted by Joe Dudash of the Colorado DRMS.No representative for the <br /> operator,Minrec,was present during the inspection.The Division has proposed a decision to approve the Phase <br /> II and Phase III Final Bond Release(SL-2)and release all jurisdiction for the reclaimed mine site. The proposed <br /> decision date was September 29,2009. Since the public notice for the SL-2 proposed decision was published on <br /> September 30,2009 and October 7,2009,the final day for public comment is Friday, October 30, 2009. <br /> Roads <br /> The public road up Hubbard Creek canyon was dry and in good condition.The mine access road across <br /> Hubbard Creek and the light use road to reclaimed pond 5 were in a similar condition. The entrance gate was <br /> closed and locked. <br /> Signs and Markers <br /> The mine identification sign and"records location"sign had been taken off of the mine entrance gate for the <br /> follow up Phase II and III bond release inspection held on August 27, 2009.The surface disturbance markers <br /> had also been taken down. <br /> Reclamation <br /> The vegetative grown at the reclaimed pond 4 area and reclaimed pond 5 area was continuing, although the <br /> vegetative cover in the area of the two ponds' reclaimed embankments was lagging behind. <br /> There was a good vegetative cover on the benches and outslopes of the reclaimed main mine site.There were no <br /> indications of slope instability or erosional problems. The vegetative cover on the reclaimed coal stockpile area <br /> also was good. <br /> Hydroloev <br /> The Hubbard Creek culvert was clear of debris.The creek was flowing. The diversion ditch at the reclaimed <br /> main mine site was well vegetated and had sufficient capacity. The road culvert at the reclaimed coal stockpile <br /> area was clear. The upland diversion ditch at the reclaimed coal stockpile area had sufficient capacity and was <br /> well vegetated. <br /> c:/word2007/blueribbon/insp 1009 <br />
