III. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the <br /> inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br /> evidence supporting the enforcement action. <br /> This was a partial inspection conducted by Joe Dudash of the Colorado DBMS.Bill Bear represented the <br /> operator during the inspection. The weather was cool and very overcast but there was no precipitation.The <br /> operator is continuing to mine in the B-8 panel at a reduced rate of about 200,000 tons per month. <br /> Main Mine <br /> The paved main haul road was in good condition. The dirt access road up to the utility bench was passable. <br /> There was only a small stockpile of coal on the main coal stockpile area and at the D-seam portal bench coal <br /> stockpile area.There was no problem with fugitive coal dust going offsite nor with coal dust being tracked onto <br /> the main highway. The mine ID sign was up at the mine site entrance and surface disturbance markers were up <br /> around the disturbed area. <br /> The cut and fill slopes of the various benches were stable.The rock catchment berm above the utility bench was <br /> functional.No large rocks were seen behind the rock catchment berm. There were no problems with any of the <br /> mine facilities on the D-seam portal bench and on the B-seam portal bench.There were no leaks at the fuel <br /> facility and the locks were on the cap and powder houses.The culverts were clear and the ditches had sufficient <br /> capacity. The main topsoil stockpile was well vegetated and the topsoil signs were up.The same was true for the <br /> topsoil stockpile on the utility bench.There was only a little standing water in pond B. The float was on the <br /> primary discharge hose. <br /> Coal Waste(Gob) Stockpiles <br /> The road to the coal waste stockpile area was dry and in good condition,with the outside edge berm and the <br /> road ditch in place.The operator was cleaning out pond C. The float was on the primary discharge pipe.There <br /> was only a little standing water in that pond. There was a moderate volume of water in pond D but there was no <br /> discharge. The topsoil stockpile in front of gob pile no. 1 was well vegetated. <br /> The operator recently had demonstrated that the outslopes of the second and higher lifts of the coal waste pile <br /> could be steepened. So topsoil and subsoil had been removed from an existing outslope and temporarily stored <br /> in piles so that the coal waste could be reworked on the outslopes. Also,uncompacted coal waste from the east <br /> side of the area was being placed onto the second lift. <br /> Hubbard Creek Vent Shaft Site <br /> The contractor was constructing the fan and deflector at the site.The mine id sign was up at the entrance and <br /> surface disturbance markers defined the disturbed area. The upland diversion ditch was in place and the <br /> riprapped section of the ditch was intact. The road section that had been reconstructed by the operator was in <br /> good condition.
