III. COMMENTS -COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during <br /> the inspection. Comments also describe any enforcement actions taken during the inspection and the <br /> facts or evidence supporting the enforcement action. <br /> This was a partial inspection conducted by Janet Binns of Colorado Division of Reclamation, Mining <br /> and Safety. The mine is a reclaimed surface mine. The weather was cool, windy and dry. The main gate <br /> on the mine access road and the gate to the load out remain locked. <br /> Roads: The mine access road was dry. The access road was drivable all the way to the facilities pad and <br /> warehouse, and liability area east of pond B. The access road to the load out was also dry. <br /> Hydrologic Balance: The Load Out was not discharging and the permanent pool of water was very low <br /> with ice forming around the edges of the pond. <br /> Reclamation Success: The Division continues to retain liability bond for two reclaimed areas at the mine <br /> site, encompassing 8 acres along with the as the access road. The Division continues to retain liability <br /> bond for the Load out and load out access road as well. The vegetation at both parcels look good and <br /> have dried down for the year. There was evidence of vehicle access to power poles east of the <br /> warehouse area. No erosional features were evident. <br /> Offsite support facilities: There has been no new activity at the load out. No problems noted with the <br /> load out pond or with the reclaimed load out area.
