III. COMMENTS -COMPLIANCE
Below are comments on the inspection. The comments include discussion of observations made during
the inspection. Comments also describe any enforcement actions taken during the inspection and the
facts or evidence supporting the enforcement action.
This was a partial inspection conducted by Janet Binns of Colorado Division of Reclamation, Mining
and Safety. The mine is a reclaimed surface mine. The weather was cool, windy and dry. The main gate
on the mine access road and the gate to the load out remain locked.
Roads: The mine access road was dry. The access road was drivable all the way to the facilities pad and
warehouse, and liability area east of pond B. The access road to the load out was also dry.
Hydrologic Balance: The Load Out was not discharging and the permanent pool of water was very low
with ice forming around the edges of the pond.
Reclamation Success: The Division continues to retain liability bond for two reclaimed areas at the mine
site, encompassing 8 acres along with the as the access road. The Division continues to retain liability
bond for the Load out and load out access road as well. The vegetation at both parcels look good and
have dried down for the year. There was evidence of vehicle access to power poles east of the
warehouse area. No erosional features were evident.
Offsite support facilities: There has been no new activity at the load out. No problems noted with the
load out pond or with the reclaimed load out area. Canada thistle by the access road gate have died
down.
