III. COMMENTS - COMPLIANCE <br /> Colowyo C-1981-019 c!;C,�' <br /> 14 Oct 2009 <br /> Pg 1/6 <br /> Below are comments on the inspection. The comments include discussion of observations <br /> made during the inspection. Comments also describe any enforcement actions taken <br /> during the inspection and the facts or evidence supporting the enforcement action. <br /> This was a partial inspection of the Colowyo Mine conducted by Jim Stark of CDRMS. <br /> The inspection was conducted on 14 and 15 October 2009. Jennifer Sekulski-Barton <br /> of CCC accompanied me on 14 October 2009 and Ryan Pawlowski of CCC <br /> accompanied me on 15 October 2009. Also present on the inspection was Johanna <br /> Cramer of CDRMS. The mine was actively mining coal and hauling coal to the <br /> loadout at the time of the inspection. The mine was also loading a train on the <br /> morning of 15 October 2009. The weather was warm and overcast and the ground <br /> was dry on both days of the inspection. There was a considerable amount of rain in <br /> the area but it did not rain at the site on either day of the inspection. The Division <br /> collected elevation data from the recently reclaimed slopes of the East Pit and the <br /> three newly constructed portions of the permanent drainage channels in the East <br /> and West Pits (the Final East Pit Ditch, the North Tributary, East Pit Ditch and the Taylor <br /> Tributary Ditch). The data was collected with a Trimble GeoXT GPS unit. The <br /> elevations shown were not based on a control point and are, therefore, relative <br /> elevations. <br /> Roads: - The main haul road to the office area and the loadout is a paved road. The <br /> road is well maintained and stable. <br /> - There is a network of haul roads in the West Pit and South Taylor Pit. These roads are <br /> all considered in-pit roads. All of these haul roads were well maintained and stable <br /> at the time of the inspection. There was some fugitive dust coming off of the roads <br /> but Colowyo had their water truck operating. They were also doing maintenance <br /> work on the roads (bading work), which is an ongoing operation at the mine. <br /> - The road in Taylor draw (to access the East Taylor, West Taylor and West Pit Ponds) <br /> was stable and well maintained at the time of the inspection. No erosional problems <br /> were noted on the road. <br /> Hydrologic Balance: - The Section 16 Pond (NPDES 009A) contained water <br /> approximately 8 feet below the top of the discharge pipe and was not discharging. <br /> The pond embankment was well vegetated and stable. <br /> - The Gossard Pond (NPDES 003A) contained water approximately 3 feet below the <br /> discharge pipe and was not discharging. The pond embankment was well <br /> vegetated and stable. The concrete sump that was built several years ago has done <br /> a good job at keeping sediment and coal fines out of the pond. <br /> - The West Pit Pond (NPDES 008A) contained water approximately 7 feet below the <br /> top of the discharge pipe and was not discharging at the time of the inspection. The <br /> embankment was well vegetated and stable. The presettling pond was almost dry. <br />
