Introduction
<br />This document is the decision package prepared by the Colorado Division of Reclamation, Mining and Safety
<br />(the Division) for the Foidel Creek Mine (C-82-056). This document includes: 1) the proposed decision to
<br />approve the permit revision No. 8 application; 2) a summary which includes a history of the review of the
<br />permit application, a description of the environment affected by the operation and a description of the mining
<br />and reclamation plan; and 3) the written findings of compliance the Division has made as required by the
<br />Colorado Surface Coal Mining Reclamation Act. Detailed information concerning the findings of compliance
<br />can be found in the Regulations of the Colorado Mined Land Reclamation Board for Coal Mining.
<br />The Division received an application for a permit revision to conduct surface coal mining and reclamation
<br />operations at the Foidel Creek Mine. A complete application was submitted by Twentymile Coal Company on
<br />May 21, 2009. The permit revision application proposes to expand the five-year mine plan to include the
<br />Western Mining District (WMD). The applicant is not proposing any new surface disturbance with this
<br />revision. The proposed mine plan expansion is located within the approved permit area.
<br />The mine will be operated by Twentymile Coal Company. The mine is located on Federal, state and private
<br />lands within Routt County, Colorado. The legal description of the lands included within the permit area is:
