The total area of pond surface exposed after December 31, 1980 for each of the unlined pits <br />shall not exceed those values listed in Table A of this approval. Should the total surface area <br />exposed exceed those amounts, an amendment will need to be filed with this office. The total <br />lagged depletions resulting from operation of the pits shall not exceed those amounts specified in <br />attached Table 1. Should the lagged depletion from any of the pits exceed the values listed in <br />Table 1, an amendment will need to be filed with this office. <br />3. All pumping for dust control shall be measured in a manner acceptable to the division engineer. <br />4. The applicant shall maintain daily records of all diversions, replacements, and the amount of <br />water used for each particular purpose. The applicant shall provide a report of these records to <br />the division engineer and the water commissioners on a monthly basis on a form approved by <br />them. The accounting must be submitted within thirty (30) calendar days of the end of the month <br />for which the accounting is being made. Failure of the Applicant to provide timely accounting to <br />the water commissioners may result in revocation of this SWSP. <br />In addition, the applicant shall submit a report from each entity making replacements; 'for this <br />plan, that entity is the City of Aurora. The report shall include an accounting of all wastewater <br />plant water effluent controlled by each entity, showing the total volume of water under its control <br />at the various wastewater treatment plants, and the amount committed to each of the recipients <br />of the water. <br />5. All releases of replacement water must be sufficient to cover all out of priority depletions and be <br />made under the direction and/or approval of the Water Commissioner(s). The replacement may <br />be aggregated to maximize beneficial use. The Water Commissioner(s) and/or Division Engineer <br />shall determine the rate and timing of an aggregated release. <br />6. The replacement water, which is the subject of this plan cannot be sold or leased to any other <br />entity. As a condition of subsequent renewals of this substitute water supply plan, the <br />replacement water must be appurtenant to this site until a plan for augmentation is obtained. A <br />copy of this approval letter should be recorded with the county clerk and recorder. All <br />replacement water must be concurrent with depletions in quantity, timing, and locations. The use <br />of replacement water must be in compliance with all agreements with the providers of <br />replacement water. <br />8. Lafarge does not anticipate dewatering any of the sites during the period of this SWSP However, <br />any future dewatering at the pits will produce delayed depletions to the stream system. As long <br />as the pit is continuously dewatered, the water returned to the stream system should be <br />adequate to offset the depletions. However, once dewatering at the site ceases, the delayed <br />depletions must be addressed. At least three years prior to completion of mining, a plan must be <br />submitted that specifies how the post pumping dewatering depletions (including refilling the pit) <br />will be replaced in time, place and amount. The Applicant is hereby notified that if dewatering <br />at any of the sites included in this plan occurs only during the summer months and the <br />pond is allowed to fill during the winter months the depletions that will have an effect on <br />the stream as a result of refilling the pit, must be addressed in any subsequent SW'SP <br />renewal for this pit. <br />8. Approval of this plan is for the purposes as stated herein. This office must first approve any <br />additional uses for which the water may be used.
